R&Q Seeks Judgment on the Pleadings on St. Paul’s Counterclaim in Reinsurance Action

PHILADELPHIA — R&Q Reinsurance Co. has moved for judgment on the pleadings on St. Paul Fire & Marine Insurance Co.’s counterclaim for breach of a facultative reinsurance certificate, arguing that St. Paul has never submitted a reinsurance billing under that certificate.

In a March 21 motion filed in the U.S. District Court for the Eastern District of Pennsylvania, R&Q maintains that the counterclaim should be dismissed for failure to state a claim.

R&Q issued two facultative reinsurance certificates to St. Paul in the late 1970s and early 1980s pursuant to a Binding Authority Agreement. The facultative certificates, known as …
