5th Circuit Declines to Reconsider Order Denying Requests by Groups to File Amici Briefs in Appeal of $502 Million Pinnacle Verdict

NEW ORLEANS –– An appellate court set to weigh in on defense challenges to a $502 million DePuy Pinnacle Hip implant verdict has declined the chance to review whether a group can file an amicus brief in the matter.

In a March 17 order, the U.S. Court of Appeals for the 5th Circuit stated that it had previously denied the motion of Texans for Lawsuit Reform for leave to file an amicus curiae brief, after which the filing party had moved for reconsideration.

“It is ordered that the motion is denied,” the 5th Circuit ruled.
