N.J. State Court Refuses to Dismiss Talc Case Without Prejudice, Says Plaintiff Has ‘Buyer’s Remorse’

TRENTON, N.J. –– The New Jersey state court overseeing the state’s coordinated talcum powder docket has refused to dismiss a complaint without prejudice, saying that plaintiff’s “buyer’s remorse” is not an “adequate justification for dismissal of her complaint.”

In the Feb. 3 order, Judge Nelson C. Johnson of the New Jersey Superior Court for Atlantic County explained that the plaintiff only wishes to dismiss her complaint in order to “explore other forums in the hopes of finding one where the science on the claimed cause of action has been resolved to claimants’ favor….”
