Ky. Federal Court Tosses Chemical Exposure Claims Against Gates Rubber Co. As Time-Barred

LOUISVILLE, Ky. –– A Kentucky federal court has dismissed a chemical exposure suit, finding that the claims were barred by the statute of limitations since, at the latest, the case was filed more than three years past the limitations period.

In the March 6 order, the U.S. District Court for the Western District of Kentucky noted that, despite being given the opportunity to do so, the plaintiff had failed to supplement their opposition to the motion to dismiss with evidence to support a tolling argument.
