Chubb’s N.J. Federal Trade Secrets Lawsuit Against Endurance Re Survives Motion to Dismiss

NEWARK, N.J. — A New Jersey federal judge has refused to dismiss a lawsuit accusing Endurance Reinsurance Corporation of America of misappropriating trade secrets, ruling that Chubb INA Holdings Inc. has sufficiently pled claims under the Computer Fraud and Abuse Act and the Defend Trade Secrets Act.

On Feb. 7, Judge Brian R. Martinotti of the U.S. District Court for the District of New Jersey held that Chubb has sufficiently alleged that Endurance conspired with certain former Chubb employees to pilfer confidential information to use in competition for clients.
