Court Refuses to Remand Orthopedic Surgeon’s Case Against Stryker

MINNEAPOLIS –– The federal court overseeing the federal multidistrict litigation docket for claims relating to Stryker’s Rejuvenate artificial hip system has refused to remand an orthopedic surgeon’s case against the company, saying that, at this time, remand would not further the purposes of the MDL.

In the Jan. 4 ruling, the U.S. District Court for the District of Minnesota agreed with Stryker that the surgeon’s claims and the claims of the patient-plaintiffs in the MDL presented similar questions of law and fact and that the parties would be engaging in much of the same discovery.
