Forum Defendant Rule Does Not Require Remand of Bravelle Action, Ill. Federal Judge Rules

CHICAGO — An Illinois federal judge has refused to remand a Bravelle action to state court based upon the forum defendant rule, holding that the plaintiffs’ product liability claims against the forum defendant have no chance of success because it did not manufacture, promote, distribute, or sell the fertility drug.

In a Jan. 12 order, Judge Amy J. St. Eve of the U.S. District Court for the Northern District of Illinois also dismissed without prejudice the claims against the defendants, ruling that they are inadequately pled and that it lacks personal jurisdiction.
