N.Y. Judge Denies Superstorm Sandy Plaintiffs’ Request to Assert Additional Claims

MINEOLA, N.Y. — A New York judge has denied plaintiffs’ motion for leave to amend their complaint against an insurer in a Superstorm Sandy coverage dispute, holding that the request is untimely because plaintiffs waited two years before filing the motion.

On Nov. 15, Judge George R. Peck of the Nassau County Supreme Court further held that the plaintiffs failed to support their proposed claim for punitive damages with allegations or facts that the insurer acted egregiously or fraudulently.
