Ill. Court Allows Plaintiff More Time to Respond to Statute of Limitations Arguments Raised in Hip Action

PEORIA, Ill. –– An Illinois federal court has vacated a status conference hearing and noted that the statute of limitations issues raised in the case would be addressed first and that the plaintiff have until Dec. 2 to respond to the defense motion.

In a Nov. 9 motion, the plaintiffs asked the U.S. District Court for the Central District of California to stay the defendant’s motion for summary judgment until after a Rule 16 scheduling conference saying that a state court recently held a hearing on a similar motion in a concurrent action.
