La. Federal Judge Dismisses LPLA Claims in DePuy DHS/DCS Hip System Action

NEW ORLEANS — A Louisiana federal judge has dismissed product liability claims asserted against DePuy in connection with its DHS/DCS Dynamic hip replacement system, finding the plaintiffs failed to explain how the device was unreasonably dangerous and deviated from specifications or performance standards.

However, in a Nov. 2 order, Judge Ivan L.R. Lemelle of the U.S. District Court for the Eastern District of Louisiana allowed the claims of redhibition and loss of consortium to proceed.
