Plaintiffs Support Efforts for New Trial, Say They Only Just Recently Discovered Falsified Data

DALLAS –– Plaintiffs whose DePuy Hip Implant claims were rejected by a Texas jury have backed their recent motion for a new trial, maintaining that newly discovered evidence in the MDL would “probably change the outcome of the trial.”

In their reply brief, filed Sept. 13 in the U.S. District Court for the Northern District of Texas, the plaintiffs maintained that they could not have discovered, with due diligence, falsified data underlying Dr. Kirk Kindsfater’s presentation at the American Association of Orhopaedic Surgeons’ annual meeting.
