U.S. Supreme Court Declines to Weigh in on Causation Dispute in Benzene Case




WASHINGTON, D.C. –– The U.S. Supreme Court has denied a petition to review a benzene-related admissibility dispute, according to the court’s online docket.

The nation’s highest court denied the petition on Oct. 11 after distributing it for the conference of Oct. 7.

In the Aug. 18 petition, the plaintiffs said that, when affirming the Eastern District of Louisiana Court’s dismissal order, the 5th Circuit U.S. Court of Appeals erred when it did not adopt a liberal interpretation of Rule 702, which would exclude expert testimony when “clearly based on ‘faulty methodology or theory.’”
