Plaintiffs in Recently Dismissed N.J. Talc Case File Appeal, Await Briefing Schedule




ATLANTIC CITY, N.J. –– The parties involved in a recently dismissed talcum powder case have appealed the court’s decision, sources told HarrisMartin, and are awaiting a briefing schedule from the state’s Appellate Division.

The appeal was filed on Sept. 22 with the Appellate Division of the New Jersey Superior Court, sources said.

The cases –– one of which was originally scheduled to begin trial on Oct. 11 –– were dismissed on Sept. 2 by the New Jersey Superior Court for Atlantic County, which opined that the expert testimony proffered by the plaintiffs was not admissible.
