R.I. Court Dismisses Asbestos Claims Against Dana Companies, Says It Doesn’t Have Jurisdiction over Company

PROVIDENCE, R.I. – A Rhode Island Superior Court has dismissed asbestos claims asserted against Dana Companies for lack of jurisdiction, ruling that the court did not have either specific or general jurisdiction over the defendant.

In the Oct. 13 ruling, the Rhode Island Superior Court additionally found that the defendant had not forfeited the jurisdiction-related defense by participating in four days of the plaintiff’s deposition.

Plaintiffs Harold Wayne Murray and Janice M. Murray filed the claims, contending that Harold Murray was diagnosed with mesothelioma in December 2015 as a result of exposure to asbestos-containing products.
