Calif. Federal Judge Dismisses Reinsurance Case for Lack of Jurisdiction; Allows Plaintiff to Replead

SAN FRANCISCO — A California federal judge has granted R&Q Reinsurance Co.’s motion to dismiss a lawsuit in which The American Insurance Co. is seeking $1.47 million in reinsurance proceeds, ruling that the complaint failed to establish that R&Q had the requisite contacts with the forum state.

However, in an Oct. 10 order, Judge John S. Tigar of the U.S. District Court for the Northern District of California allowed TAIC to amend its complaint to add facts establishing personal jurisdiction over R&Q.
