Miss. Supreme Court Reverses JNOV Order, Says Asbestos Plaintiff Presented Sufficient Evidence to Support Jury’s $3.8 Million Verdict

JACKSON, Miss. –– The Mississippi Supreme Court has reversed a trial court’s order granting a defense motion for judgment notwithstanding the verdict, reiterating that the jury is the sole judge of the witness’s credibility and the plaintiff had submitted sufficient evidence to support the asbestos-related claims.

In the Sept. 22 opinion, the state high court said that the trial court’s sole reason for reaffirming JNOV was that the plaintiff had presented insufficient evidence of the alleged exposure.
