Oregon Supreme Court Declines Opportunity to Weigh in on Bare Metal Defense Ruling

SALEM, Ore. –– The Oregon Supreme Court has declined to review an intermediate appellate court decision reversing an award of summary judgment to Warren Pumps on grounds that the defendant could be held strictly liable for asbestos-containing component parts it did not manufacture or sell since its pumps were “expected to, and did, reach users without substantial change in the condition in which they were sold.”

The state high court issued its one-page order denying review on Sept. 15. The decision not to weigh in on the dispute allows an Oregon Court of Appeals April opinion to stand.
