ObTape MDL Judge Threatens Counsel with Sanctions for Pursuing Time-Barred Actions

MACON, Ga. — The judge overseeing the Mentor Corp. ObTape Transobturator Sling federal docket has said “enough is enough” in warning plaintiffs’ counsel that they will be sanctioned for pursuing actions that are clearly time-barred through the summary judgment stage.
In a Sept. 7 order, Judge Clay D. Land of the U.S. District Court said that in future orders awarding summary judgment in which no good faith basis existed for maintaining the action, he will require counsel to show cause why sanctions should not be imposed.
