New Mexico Plaintiffs Oppose Motion to Stay Talcum Powder Case, Say Court Doesn’t Have Jurisdiction

ALBUQUERQUE, N.M. – Plaintiffs whose talcum powder claims were removed to New Mexico federal court have opposed a recent defense motion to stay the proceedings, arguing that because the court lacks subject matter jurisdiction over the matter, it cannot rule on the pending motion to stay.

In an Aug. 23 opposition brief filed in the U.S. District Court for the District of New Mexico, the plaintiffs additionally stated that if the court does, in fact, find that it has jurisdiction over the matter, staying the case would be unfairly prejudicial to the plaintiffs, who are “seeking timely justice for a …
