NEW YORK — A New York judge has dismissed without prejudice an action seeking coverage for Superstorm Sandy-related theft losses, ruling that the plaintiff failed to show good cause for his failure to serve the insurer defendants with a summons.
In an Aug. 3 order, Judge Sherry Heitler of the New York County Supreme Court refused to grant the plaintiff an extension to serve those defendants, noting that he gave no explanation for failing to respond to their demand for complaint.
