Pinnacle Hip Implant Plaintiffs File Notice of Cross-Appeal, Contest Court’s Decision to Reduce $502 Million Verdict

DALLAS –– Plaintiffs asserting personal injury claims relating to DePuy’s Pinnacle Hip Implant have filed a cross-appeal, contesting the MDL Court’s decision to reduce the exemplary damages awarded as part of the $502 million total verdict.

In the Aug. 3 notice of cross-appeal filed in the U.S. District Court for the Northern District of Texas, the plaintiffs said that the cap on exemplary damages in unconstitutional and that the court should have entered judgment for the full amount of exemplary damages awarded by the jury.
