COLUMBUS, Ga. — Claims asserted against Mentor Corp. in connection with its ObTape suburethral sling are barred by South Carolina’s six-year statute of repose because the plaintiff did not file suit until eight years after her device was implanted, a Georgia federal judge has ruled.

In an Aug. 15 order, Judge Clay D. Land of the U.S. District Court for the Middle District of Georgia found the action does not fall within the “disease exception” to the statute of repose because the plaintiff did not point to any evidence that she was diagnosed with a disease.
