Defendants Indicate Intent to Appeal $1.76 Million Judgment Entered for Benzene Plaintiff

DES MOINES, Iowa –– Defendants Lyondell Chemical Co., Equistar Chemicals LP and Equistar GP, LLC, have filed a notice of appeal, indicating their intent to contest a $1.76 million judgment entered at the conclusion of a benzene trial.

The defendants filed their notice of appeal with the U.S. District Court for the Southern District of Iowa on Aug. 11.

The notice was filed nearly one month after the federal court entered a final judgment in the case, throwing out an award of $1.76 million in punitive damages, but allowing the same amount of actual damages to stand.
