WILMINGTON, Del. –– A Delaware judge has recommended that six defendants named in an asbestos personal injury action be awarded summary judgment, opining that the plaintiffs had failed to show that a product for which the defendants were responsible was a substantial contributing factor in the injured party’s development of mesothelioma.
In a July 28 report and recommendation, Judge Sherry R. Fallon of the U.S. District Court for the District of Delaware opined that the court should award summary judgment to ABB Inc., CBS Corp., BW/IP Inc., Eaton Corp., Union Carbide Corp., and Gould Electronics Inc.
