Biomet Hip MDL Court: Distributors Can Be Held Strictly Liable for Defective Products

SOUTH BEND, Ind. –– The court overseeing the Biomet M2a Magnum hip implant multidistrict litigation have remanded three cases to Florida state court, finding that the distributors named in the action as defendants were not fraudulently joined.

In the July 18 order, the U.S. District Court for the Northern District of Indiana ruled that Florida courts have “consistently” held that medical device distributors can, in fact, be held strictly liable for product defects.

Plaintiffs Rita Taranto, Griseth DeJesus and Chanton Harris filed the claims in Florida state court, contending that they were injured by defective M2a Magnum hip implants manufactured …
