Calif. Federal Judge Refuses to Dismiss Tasigna Wrongful Death Action on Timeliness Grounds

SACRAMENTO, Calif. — A California federal magistrate judge has denied Novartis’ motion to dismiss a Tasigna wrongful death action, ruling that questions of fact surround the issue of whether the action was timely filed.

In a July 22 order, Magistrate Judge Stanley Boone of the U.S. District Court for the Eastern District of California explained that the question of whether the plaintiff’s later-discovered injury is related to his older injuries, or constitutes a “new” injury that would toll the limitations period.
