Defendants in Fluoroquinolone MDL Not Required to Produce Sales Rep Custodial Files, Judge Says

MINNEAPOLIS — Defendants in the fluoroquinolone multidistrict litigation are not required to produce sales representative custodial files with their Defendant Fact Sheets as part of case-specific discovery, a Minnesota federal judge has ruled.

In a July 20 order, Chief Judge John R. Tunheim of the U.S. District Court for the District of Minnesota held that in light of “the significant burden the proposed custodial-file searches would impose on defendants, and the less-than-certain benefits of such searches,” defendants do not have to engage in those searches at this time.
