Biomet M2a Magnum Hip Implant MDL Court: Distributors Can Be Held Strictly Liable for Defective Products

SOUTH BEND, Ind. –– The federal court overseeing the national coordinated docket for claims related to Biomet’s M2a Magnum hip implant have remanded three cases to Florida state court, finding that the distributors named in the action as defendants were not fraudulently joined.

In the July 18 order, the U.S. District Court for the Northern District of Indiana ruled that Florida courts have “consistently” held that medical device distributors can, in fact, be held strictly liable for product defects.
