Pinnacle Knee Implant MDL Court Rejects Defense Efforts to Stay Bellwether Trails Pending Appeal of Verdict

DALLAS –– The federal court overseeing the national coordinated docket for claims related to DePuy’s Pinnacle knee implant has rejected defense efforts to stay future trials pending the resolution of the appeal of a $502 million verdict –– which has since been reduced –– ruling that the defendant cannot grant a stay every time the plaintiffs win a trial.

In the July 5 order, the U.S. District Court for the Northern District of Texas said that the defendants agreed to the bellwether process and exercised a clear Lexecon waiver to have those cases tried in the Northern District of Texas.
