ALBUQUERQUE, N.M. –– Imerys Talc America Inc. has filed a motion to dismiss a New Mexico talcum powder lawsuit on a number of grounds, including that the court does not have personal jurisdiction over the matter and that the plaintiffs’ civil conspiracy and fraud claims have not been pled with sufficient particularity.

In the July 1 motion filed in the U.S. District Court for the District of New Mexico, the defendant further maintained that since it is not a resident of New Mexico and the products at issue were purchased and used outside of the state, the venue is improper …
