Missouri Federal Court Remands Talcum Powder Suit, Says Claims of 80 Plaintiffs Not Misjoined

ST. LOUIS –– A Missouri federal court has remanded a talcum powder exposure suit, rejecting Johnson & Johnson’s position that the claims of 80 plaintiffs were misjoined and finding that the underlying claims were “sufficiently related to support joinder in this case.”
In the July 11 ruling, the U.S. District Court for the Eastern District of Missouri said that the defendants had failed to demonstrate diversity of citizenship and, as a result, the court lacked subject matter jurisdiction over the case.
