R&Q Urges Calif. Federal Court to Dismiss $1.5 Million Reinsurance Action for Lack of Jurisdiction

SAN FRANCISCO — R&Q Reinsurance Corp. has moved to dismiss for lack of jurisdiction an action filed in California federal court seeking $1.5 million in reinsurance proceeds for an underlying asbestos settlement, arguing that it has no “continuous and systematic” contacts with California.

In a July 1 motion filed in the U.S. District Court for the Northern District of California, R&Q argued that it is not “at home” in California, nor do plaintiff The American Insurance Co.’s claims arise out of contacts or affiliations R&Q has with California. TAIC therefore, cannot sustain its due process burden, R&Q maintains.
