1st Circuit Denies Petition for Rehearing in Benzene-Related Causation Dispute

BOSTON –– The 1st Circuit U.S. Court of Appeals has denied a petition for rehearing en banc, declining the chance to take a second look at a dispute over specific causation testimony in a benzene exposure suit.

In the two-page order issued on June 13, the 1st Circuit said that the “petition for rehearing en banc having been submitted to the active judges of this court and a majority of the judges not having voted that the case be heard en banc, it is ordered that the petition for rehearing and petition for rehearing en banc be denied.”
