N.Y. Court Grants Stryker and Howmedica’s Motion to Dismiss Implant Suit, Says Plaintiff Failed to Allege Defect

NEW YORK - A New York federal court has dismissed a leg metal plate implant suit, concluding that the plaintiff had failed to plead “a single fact that could put defendants on notice on how the metal plate, or its warnings, were defective.”

In the May 23 order, the U.S. District Court for the Southern District of New York granted the defendants’ motion to dismiss and instructed the Clerk to close the case.
