Maryland Federal Court Denies Defense Efforts to Toss Fraud, Conspiracy Claims in Talc-Based Powder Case

BALTIMORE –– A Maryland federal court has denied defendants’ motion in a talc-based powder exposure lawsuit to dismiss fraud, intentional misrepresentation and fraud-concealment claims, saying that it was satisfied that the counts state claims upon which relief could be granted.
In a one-page memo to counsel, Judge J. Frederick Motz of the U.S. District Court for the District of Maryland added that “despite the informal nature of this letter, it should be flagged as an opinion and docketed as an order.”
