Ohio Court of Appeals Affirms Asbestos Plaintiff Verdict; Remands Case for New Trial on Punitive Damages

CLEVELAND –– An Ohio appellate court has affirmed a compensatory verdict entered in favor of an asbestos plaintiff, but reversed a trial court order that granted Honeywell’s directed verdict on punitive damages, opining that enough evidence had been presented to support a finding that Bendix “manifested a flagrant disregard of the safety of persons who might be harmed by the product in question.”

In the Ohio Court of Appeals, 8th District, Cuyahoga County, remanded the case to the trial court to conduct a new trial on plaintiffs’ claim for punitive damages.
