Mo. Federal Judge Limits Plaintiffs’ Testimony in Depakote Birth Defect Action

ST. LOUIS — A Missouri federal judge has limited the testimony of a plaintiffs’ expert in a Depakote birth defect case, barring him from testifying as to whether the plaintiffs’ son may develop future medical needs, or whether his spina bifida caused him to develop poor eye muscle coordination and hearing loss.

On May 6, Judge Charles A. Shaw of the U.S. District Court for the Eastern District of Michigan also barred a second plaintiffs’ expert from testifying as to whether it would have been reasonable for Abbott Laboratories Inc. to establish a registry of exposed pregnancies.
