Calif. Court Dismisses Negligent Misrepresentation, Express Warranty Claims in Roundup Suit, Allows Plaintiffs to Amend

SAN DIEGO –– A California federal court has dismissed claims of negligent misrepresentation, express warranty and failure to warn the Environmental Protection Agency asserted in a Roundup exposure suit, ruling that while the plaintiff will be given a chance to amend his suit, the claims do not assert a claim upon which relief can be granted.

In the April 29 order, the U.S. District Court for the Southern District of California did allow a number of other claims to proceed in the case, including ones for design defect and failure-to-warn the public.
