Ariz. Judge Refuses to Adopt Proposed Statute of Limitations Procedure in Bard IVC Filter MDL

PHOENIX — The judge overseeing the Bard IVC filter products multidistrict litigation has refused to adopt a proposed procedure for the court to rule on whether a statute of limitations can be equitably tolled beyond the time a plaintiff discovered an injury related to a Bard filter.

On April 20, Judge David Campbell of the U.S. District Court for the District of Arizona explained that the procedure, which was used in another MDL, should not be used in the Bard MDL because the circumstances in the instant litigation are different.
