Ill. Federal Judge Dismisses Fusion Nail System Lawsuit Without Prejudice, Allows Plaintiff to Amend

CHICAGO — An Illinois federal judge has dismissed without prejudice a lawsuit involving the Trigen Hindfoot Fusion Nail system and other tibial implant components, ruling that the plaintiff failed to identify which defendant’s product failed.

On April 11, Judge John J. Tharp, Jr. of the U.S. District Court for the Northern District of Illinois allowed the plaintiff to amend her claims, directing her to identify the specific components that failed and which defendant manufactured those components.
