Roundup Plaintiff Moves to Remand; Monsanto Opposes, Still Says In-State Defendants Fraudulently Joined

SAN FRANCISCO –– A plaintiff has moved a California federal court to remand his Roundup exposure lawsuit, contending that he can, in fact, recover on his claims against an in-state distributor defendant and an in-state sales executive.

In an April 13 opposition brief filed in the U.S. District Court for the Northern District of California, Monsanto maintained that the plaintiff had failed to establish viable claims against the in-state defendants and, further, that declarations submitted in support of the remand motion were inadmissible.
