N.J. State Court Allows Defendants to Test Tissue Samples from Decedent in Benzene Case

CAMDEN, N.J. –– A New Jersey state court has granted a defense motion to obtain tissue samples from the decedent in a benzene case in order to perform genetic testing, according to a recent court order.

In the March 14 order, the New Jersey Superior Court for Camden County ordered the plaintiffs to provide appropriate authorizations to the defendants for the release of the pathology specimens.

The underlying lawsuit involves claims asserted on behalf of Nilton Cacoilo, who was a member of the U.S. Marine Corps. While in the service, Cacoilo was allegedly exposed to benzene-containing products manufactured by the …
