Scottsdale Opposes John Deere’s Request for $28,680 in Attorneys’ Fees Following Confirmation of Award

PHOENIX — Scottsdale Insurance Co. has opposed John Deere Insurance Co. request for $28,680.20 in attorneys’ fees and costs following confirmation of a reinsurance arbitration award, arguing that the arbitration agreement provides only for recovery of confirmation-related fees, not fees incurred in other phases of the proceedings.

In a March 31 opposition filed in the U.S. District Court for the District of Arizona, Scottsdale further argues that under Arizona law, John Deere cannot recover beyond what it is entitled to under the arbitration agreement. As such, John Deere is entitled only to a fraction of the claimed fees, Scottsdale maintains.
