N.C. Court Throws Out Punitive Damage Claim in Asbestos Case; Allows Other Claims to Proceed Against Honeywell

GREENSBORO, N.C. –– A North Carolina federal court has awarded Honeywell International summary judgment on a number of asbestos-related claims, finding that the evidence was insufficient to support causes of action for willful and wanton conduct and punitive damages.
In the April 4 opinion, the U.S. District Court for the Middle District of North Carolina did allow claims of negligence, negligent failure-to-warn, defective design, wrongful death, and breach of implied warranty to proceed to trial.
The court also dismissed the fraud claim, noting that the plaintiff did not oppose the defendant’s motion for summary judgment on that claim.
