5th Circuit Schedules Oral Argument in Dispute Over Whether Benzene Causation Evidence Can Be Used to Support Gasoline Case

NEW ORLEANS –– The 5th Circuit U.S. Court of Appeals has scheduled oral arguments as it prepares to address a Louisiana court’s dismissal of a benzene lawsuit on the ground that the plaintiff had not supported her gasoline exposure case with admissible evidence.

In the Feb. 23 order, the 5th Circuit said that it had tentatively scheduled the case for oral argument during the week of April 25.

The plaintiffs asserted the claims on behalf of Bernard E. Burst Jr., whose work at a number of gas stations allegedly exposed him to benzene-containing gasoline. As a result of the …
