R&Q Moves to Remand Lawsuit Seeking Rescission of Reinsurance Certificates Issued to Allianz

NEW YORK — R&Q Reinsurance Co. has moved to remand a lawsuit in which it seeks rescission of two facultative certificates issued to Allianz Insurance Co., asserting that because the original complaint was filed more than a year ago, the deadline for removal has expired.

In a Feb. 23 motion filed in the U.S. District Court for the Southern District of New York, R&Q further contends that Allianz is collaterally estopped from removing the case to federal court because its first attempt at removal, made just after the original complaint had been filed, was rejected by the District Court.
