MDL Judge Retains Jurisdiction Over Androgel Action, Dismisses Sole Nondiverse Plaintiff

CHICAGO — The judge overseeing the federal multidistrict litigation docket for testosterone replacement therapy products has refused to remand a case filed by ten individuals against Abbot Laboratories, ruling that the transferor court lacked personal jurisdiction over the sole nondiverse plaintiff.

On Feb. 18, Judge Matthew F. Kennelly of the U.S. District Court for the Northern District of Illinois concluded that the plaintiffs’ claims lack the requisite contacts with Missouri, where the action had been originally filed.

Plaintiffs in these cases allege they suffered cardiovascular, thromboembolic (blood clotting), or cerebrovascular injuries caused by their use of AndroGel.
