Durom Hip Cup MDL Judge Seeks Clarification on Common Benefit Fund Assessment Order

NEWARK, N.J. –– The New Jersey judge overseeing the nation’s coordinated docket for Durom Hip Cup claims has asked a magistrate judge to clarify his order reducing a common benefit fund assessment, saying that the order did not explain what metrics or factors were considered before making the reduction.

In a Feb. 22 letter, Judge Susan D. Wigenton of the U.S. District Court for the District Court of New Jersey said she could not conduct a meaningful review of the decision without those details.

Judge Wigenton noted that she had reached its decision without oral argument.
