JPML Vacates Transfer Order, Says Case Doesn’t Fit Into NexGen Knee Implant MDL Proceedings

WASHINGTON, D.C. –– The U.S. Judicial Panel on Multidistrict Litigation has granted a motion to vacate a transfer order, agreeing with the parties that the underlying case asserts claims related to a Zimmer product outside the scope of the multidistrict proceedings.

In the Feb. 2 order, the JPML said that the Cassano action –– originally filed in the Central District of California –– did not allege claims relating to the NexGen flex femoral component or the NexGen MIS Tibial component.

Defendants Zimmer Inc., Zimmer Biomet Holdings Inc., and Zimmer Surgical Inc., however, moved to vacate the transfer order, contending …
