Subcontractor Defendant Involved in Dispute Over Its Liability for Asbestos Claims Files Petition in Supreme Court




SAN FRANCISCO –– A defendant subcontractor that recently saw a nonsuit entered in its favor in an asbestos action reversed has petitioned the California Supreme Court for review, according to the court’s online docket.

In its Jan. 29 petition, E.F. Brady is contesting an appellate court’s finding that its purchase of defective products, combined with its ongoing relationship with the manufacturers of those products, was enough to support the imposition of strict liability.

The state high court received the record from the California Second District Court of Appeal on Feb. 2.
